Seniority Rules Reference

Civil Servants (Seniority) Rules, 1993

Rule 2: Seniority on initial appointment

Key Principle: Seniority is determined from the date of regular appointment.

Implementation: When multiple officers are appointed on the same day, their inter se seniority is determined by:

  1. Order of merit assigned by the appointing authority
  2. If merit order is same, then by age (older is senior)
  3. If age is same, then by higher qualification

Rule 3: Seniority on promotion

Key Principle: Seniority is determined from the date of regular promotion.

Implementation: When multiple officers are promoted on the same day:

  1. Their inter se seniority follows their seniority in the lower post
  2. For officers from different occupational groups, seniority is determined from promotion date
  3. Batch promotions retain their lower post seniority

Rule 4: Seniority on appointment by transfer

Key Principle: Seniority is determined from the date of regular appointment by transfer.

Implementation: When multiple officers are transferred on the same day:

  1. Their inter se seniority follows their seniority in the previous service
  2. For officers from different services, seniority is determined from transfer date
  3. Service gaps are considered in seniority calculation

Rule 4A: Seniority in case of merger/devolution

Key Principle: Seniority is determined from the date of regular appointment to the cadre/post.

Implementation: When services or posts are merged:

  1. Officers retain their original appointment dates
  2. For officers merged on same day, inter se seniority follows their previous service seniority
  3. Merger terms are considered in seniority determination

Rule 5: Seniority of officers of the Armed Forces on induction

Key Principle: Seniority is determined from the date of induction.

Implementation: When multiple officers are inducted on the same day:

  1. Their inter se seniority follows their military seniority
  2. Branch-specific rules may apply for inter-service seniority
  3. Military service length is considered
